(The document as of February, 2008) Statutory Instruments2007 No. 3232 (W.284) (C.132)HOUSING, WALESThe Housing Act 2004 (Commencement No 5) (Wales) Order 2007Made 12 November 2007 The Welsh Ministers, in exercise of the powers conferred on the National Assembly for Wales by section 270(4) and (5)(c) of the Housing Act 2004(1) and now vested(2) in the Welsh Ministers, make the following Order: Title and application1. --(1)В This Order is called the Housing Act 2004 (Commencement No 5) (Wales) Order 2007. (2)В This Order applies in relation to Wales. Provisions coming into force on 13 December 20072. В В The following provisions of the Housing Act 2004 come into force on 13 December 2007: (a) section 225 insofar as it is not already in force(3); (b) section 226; (c) section 265(1) insofar as it relates to paragraph 47 of Schedule 15. Jocelyn Davies Under authority of the Minister for the Environment, Sustainability and Housing, one of the Welsh Ministers 12 November 2007 Explanatory Note(This note is not part of the Order) This Order is the fifth Commencement Order made under the Housing Act 2004. It brings sections 225 (duties of local housing authorities: accommodation needs of gypsies and travellers) and 226 (guidance in relation to section 225) of, and paragraph 47 of Schedule 15 (housing strategies and statements under section 87 of the Local Government Act 2003)) to, the Housing Act 2004 into force in Wales on 13 December 2007. Note as to Earlier Commencement Orders(This note is not part of the Order) The following provisions of the Housing Act 2004 have been brought into force in Wales by commencement orders made before the date of this Order:
2004 c. 34. The powers conferred by section 270(4) and (5) are exercisable, as respects Wales, by the National Assembly for Wales. See the definition of the "appropriate national authority" in section 261(1) of the 2004 Act. Back [1] ( 2 )The powers of the National Assembly for Wales under section 270(4) and (5) are transferred to the Welsh Ministers by paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32). Back [2] ( 3 )So far as a provision of the 2004 Act confers power to make an order or regulations exercisable by the National Assembly for Wales it came into force on the passing of that Act by virtue of section 270(2)(b) of the Act.
