National Health Service (Pharmaceutical Services) (Amendment) (Wales) Regulations 2006

The National Assembly for Wales, in exercise of the powers conferred by sections 42, 43 and 126(4) of the National Health Service Act 1977[1] makes the following Regulations:

Title, commencement, application and interpretation
    1.—(1) The title of these Regulations is the National Health Service (Pharmaceutical Services) (Amendment) (Wales) Regulations 2006 which come into force on 16 November 2006.

    (2) These Regulations apply in relation to Wales.

    (3) In these Regulations the "Pharmaceutical Regulations" ("y Rheoliadau Fferyllol") means the National Health Service (Pharmaceutical Services) Regulations 1992[2].

Amendment of Schedule 2 to the Pharmaceutical Regulations
    2.In Schedule 2, Part 6, to the Pharmaceutical Regulations, in paragraph 38 (fees and charges), for paragraph 38(2) substitute —

        " (2) Where a doctor who is authorised or required, in accordance with regulation 20, to provide drugs or appliances under pharmaceutical services or provides any additional service associated with the dispensing of such drugs and appliances in accordance with an agreement with the Local Health Board —

      (a) in accordance with this Part or an agreement with the Local Health Board; and

      (b) had the drug, appliance or additional service been provided by a contractor providing dispensing services under a GMS contract, the contractor would have been entitled, by virtue of directions given by the National Assembly for Wales under section 28T of the Act, to a payment —

        (i) in respect of the drug or appliance; or

        (ii) in respect of the additional service provision,

      the Local Health Board will credit him or her with the payment.".

EXPLANATORY NOTE

(This note is not part of the Regulations)


The Regulations amend the National Health Service (Pharmaceutical Services) Regulations 1992.

The Regulations make provision in respect of fees and charges payable to a doctor who is authorised or required to provide drugs or appliances under pharmaceutical services or provides any additional service associated with the dispensing of such drugs and appliances.
