The Secretary of State for Health makes this Order in exercise of the powers conferred by section 22(1) of the Tobacco Advertising and Promotion Act 2002[1]. Citation and extent 1.—(1) This Order may be cited as the Tobacco Advertising and Promotion Act 2002 (Commencement No. 9) Order 2006. (2) This Order extends to England, Wales and Northern Ireland only. Appointed day 2.26th September 2006 is the appointed day for the coming into force of the Tobacco Advertising and Promotion Act 2002 in so far as that Act is not already in force. Signed by authority of the Secretary of State Caroline Flint Minister of State for Public Health Department of Health 24th August 2006 (This note is not part of the Order) This Order brings into force the Tobacco Advertising and Promotion Act 2002 ("the Act") in so far as it is not already in force. Section 2 of the Act was not previously in force in relation to website advertising. The Tobacco Advertising and Promotion Act 2002 etc. (Amendment) Regulations 2006[2] also insert new provisions into the Act. This Order does not apply to Scotland. (This note is not part of the Order) This Order concludes the bringing into force of the Tobacco Advertising and Promotion Act 2002 in relation to England, Wales and Northern Ireland. The following provisions of the Act have been brought into force in England, Wales and Northern Ireland by commencement orders made before the date of this Order.
