The Animals and Animal Products (Import and Export) (Wales) (Amendment) Regulations 2006

The National Assembly for Wales is designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the Common Agricultural Policy of the European Community.

Title, application and commencement
    1.—(1) The title of these Regulations is the Animals and Animal Products (Import and Export) (Wales) (Amendment) Regulations 2006.

    (2) These Regulations apply in relation to Wales.

    (3) These Regulations come into force on 1 August 2006.

Amendment to the Animal and Animal Products (Import and Export) (Wales) Regulations 2006
    2.—(1) The Animals and Animal Products (Import and Export) (Wales) Regulations 2006[3] are amended in accordance with this regulation.

    (2) In regulation 1(3)—

(a) in the definition of "Council Directive 90/425/EEC" for "paragraph 4(a)" substitute "paragraph 5(a)"; and

(b) in the definition of "Council Directive 91/496/EEC" for "paragraph 4(b)", substitute "paragraph 5(b)".

    (3) In regulation 16(4), for "1st August 2006", substitute "1 January 2007".

    (4) In regulation 19(9), after "an inspector" add "in the case of sub-paragraphs (a) and (b), and a veterinary inspector in the case of sub-paragraph (c)".

    (5) In regulation 21(3), for "the veterinarian inspector", substitute "the veterinary inspector".

    (6) In regulation 22(6), delete "22 or".

    (7) In regulation 28(2) for "paragraph 28", substitute "paragraph (1)".

    (8) In regulation 35(1), after "Part IV" and before "of", insert " of Schedule 8 to ".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Animals and Animal Products (Import and Export) (Wales) Regulations 2006 (S.I. 2006/1536 (W. 153)) ("the principal Regulations").

Regulation 2(3) amends the principal Regulations to give effect to the extension of the European Union ban under Commission Decision 2005/760/EC (OJ L. No. 285, 28.10.2005, p.52, as amended by Commission Decision 2006/522/EC, OJ No. L 205, 27.7.2006, p.28) on the import of captive birds from third countries until 1 January 2007.

Regulation 2 of these Regulations also makes minor adjustments and corrections to other provisions in the principal Regulations.
