TERMS AND CONDITIONS OF EMPLOYMENT


The Work and Families Act 2006 (Commencement No. 1) Order 2006


 Made25th June 2006 

The Secretary of State makes the following Order in exercise of the powers conferred upon him by section 19(2) and (3) of the Work and Families Act 2006[1].

Citation and Interpretation
    1.—(1) This Order may be cited as the Work and Families Act 2006 (Commencement No. 1) Order 2006.

    (2) In this Order—

    "the 1992 Act" means the Social Security Contributions and Benefits Act 1992[2]; and

    "the 2006 Act" means the Work and Families Act 2006.

Provisions coming into force on 27th June 2006
    2.The following provisions of the 2006 Act shall come into force on 27th June 2006—

    (a) section 1, for the purpose of the power in section 165(1) of the 1992 Act to prescribe the maternity pay period;

    (b) section 2, for the purpose of the power in section 171ZN(2) of the 1992 Act to prescribe the adoption pay period;

    (c) section 11, in so far as it relates to the provisions in Schedule 1 to the 2006 Act which are brought into force by this article; and

    (d) Schedule 1, paragraphs 6, 7, 9, 21, 31, 32, 33 and 34, for the purpose of the powers to prescribe matters by regulations.

Provisions coming into force on 1st October 2006
    3.The following provisions of the 2006 Act shall come into force on 1st October 2006—

    (a) section 1 for all purposes other than those referred to in article 2;

    (b) section 2 for all purposes other than those referred to in article 2;

    (c) section 11 in so far as it relates to the provisions in Schedule 1 to the 2006 Act which are brought into force by this article;

    (d) Schedule 1, paragraphs 6, 7, 9, 21, 31, 32, 33 and 34, for all purposes other than those referred to in article 2;

    (e) Schedule 1, paragraphs 8 and 23;

    (f) section 13;

    (g) section 14;

    (h) section 15 in so far as it relates to the provisions in Schedule 2 to the 2006 Act which are brought into force by this Order; and

    (i) Schedule 2 (repeals) in so far as it gives effect to the following repeals—

      (i) the definition of "week" in section 171(1) of the 1992 Act; and

      (ii) section 18 of the Employment Act 2002[3].

Provisions coming into force on 6th April 2007
    4.The following provisions of the 2006 Act shall come into force on 6th April 2007—

    (a) section 12; and

    (b) Schedule 2 (repeals) in so far as it gives effect to the repeal of section 80F(3), (6) and (7) of the Employment Rights Act 1996[4].

EXPLANATORY NOTE

(This note is not part of the Order)


This Order brings into force certain provisions of the Work and Families Act 2006 (c.18) (the 2006 Act). Article 2 lists those provisions of the 2006 Act that will come into force on 27th June 2006. Article 3 lists the provisions that will come into force on 1st October 2006 and article 4 lists those provisions that will come into force on 6th April 2007.

Sections 16, 17, 18, 19 and 20 of the 2006 Act came into force on Royal Assent.
