The General Dental Council (Constitution of Committees) Order of Council 2006

Their Lordships make the following Order in exercise of their powers conferred under section 2(6) and (7) of the Dentists Act 1984[1].

Citation and commencement
    1.This Order may be cited as the General Dental Council (Constitution of Committees) Order of Council 2006 and shall come into force on 31st July 2006.

Constitution of the Health Committee, Interim Orders Committee, Investigating Committee, Professional Conduct Committee, Professional Performance Committee and Registration Appeals Committee
    2.—(1) The Health Committee, the Interim Orders Committee, the Investigating Committee, the Professional Conduct Committee, the Professional Performance Committee and the Registration Appeals Committee shall each consist of five natural persons, of good character, who are fit and proper persons to act as members of a committee of the Council.

    (2) Of those five persons—

(a) at least one shall be a natural person who is neither a registered dentist nor a registered dental care professional;

(b) at least one shall be a registered dentist; and

(c) in any case concerning a person's registration in the dental care professionals register, at least one shall be a registered dental care professional.

Revocations
    3.Subject to article 4, the following are revoked—

(a) the General Dental Council (Constitution of Committees) Order of Council 2003[2]; and

(b) the General Dental Council (Constitution of Committees) Amendment Order of Council 2003[3].

Saving
    4.The General Dental Council (Constitution of Committees) Order of Council 2003 shall continue in force for the purposes of the exercise of functions by the committees to which that Order applies in accordance with Schedule 7 to the Dentists Act 1984 (Amendment) Order 2005[4] or the Dentists Act 1984 (Amendment) Order 2005 Transitional Provisions Order of Council 2006[5].

EXPLANATORY NOTE

(This note is not part of the Order)

This Order provides for the constitution of the six committees of the General Dental Council referred to in section 2 of the Dentists Act 1984, namely the Health Committee, the Interim Orders Committee, the Investigating Committee, the Professional Conduct Committee, the Professional Performance Committee and the Registration Appeals Committee.

The previous General Dental Council (Constitution of Committees) Order of Council is revoked, with a saving for cases in which that Order continues in force.
