The Secretary of State has been designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community. She makes the following Regulations under the powers conferred by that section: Citation, commencement and application 1.—(1) These Regulations may be cited as the Welfare of Animals (Slaughter or Killing) (Amendment) (England) Regulations 2006. (2) These Regulations come into force on 29 April 2006. (3) These Regulations apply in relation to England only. Amendment of the Welfare of Animals (Slaughter or Killing) Regulations 1995 2.—(1) Amend Schedule 9 to the Welfare of Animals (Slaughter or Killing) Regulations 1995[3] as follows. (2) In paragraph 1, after the definition of "disease control", insert—

6.—(1) No person shall kill birds using ventilation shutdown except on the written authority of the Secretary of State who must be satisfied in the individual circumstances that any other method of killing listed in this Schedule is impracticable. (2) No person shall cause or permit birds to be killed using ventilation shutdown unless under the direct supervision of an official of the Secretary of State.".
(This note is not part of these Regulations) These Regulations, which apply in England only, amend the Welfare of Animals (Slaughter or Killing) Regulations 1995 (S.I. 1995/731). The 1995 Regulations give effect to Council Directive 93/119/EC on the protection of animals at the time of slaughter or killing (OJ No. L 340, 31.123, p.21). These Regulations permit ventilation shutdown as a method of killing birds for the purpose of disease control. A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
