The Common Agricultural Policy Single Payment and Support Schemes (Amendment No. 2) Regulations 2006

The Secretary of State for Environment, Food and Rural Affairs makes the following Regulations under the powers conferred by section 2(2) of the European Communities Act 1972[1].

    She has been designated[2] for the purposes of that section in relation to the common agricultural policy of the European Community.

Title and commencement
    1.—(1) These Regulations may be cited as the Common Agricultural Policy Single Payment and Support Schemes (Amendment No. 2) Regulations 2006.

    (2) These Regulations come into force on 14th February 2006.

Amendment of the definition of "moorland"
    2.—(1) The Common Agricultural Policy Single Payment and Support Schemes Regulations 2005[3] are amended as follows.

    (2) In the definition of "moorland" in regulation 2(1), for paragraph (b) substitute—

      " (b) shown coloured pink in the three volumes of maps entitled "Moorland Map of England 2006" each volume being marked with the number of the volume, dated 13th February 2006, signed on behalf of the Secretary of State for Environment, Food and Rural Affairs and deposited at the offices of the Department for Environment, Food and Rural Affairs at Ergon House, Horseferry Road, London SW1P 2AL;".

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the definition of "moorland" in the Common Agricultural Policy Single Payment and Support Schemes Regulations 2005 ("the 2005 Regulations"). The 2005 Regulations defined moorland by reference to the Moorland Map of England 1992. That map was reviewed in 2005 and 2006 and a new map, called the "Moorland Map of England 2006" was compiled. The definition of "moorland" in the 2005 Regulations is accordingly amended by these Regulations to refer to the Moorland Map of England 2006.

A full regulatory impact assessment has not been produced for these Regulations as they have no impact on the costs of business.
