Her Majesty, in pursuance of the powers conferred upon Her by sections 1, 2, 3, 5 and 6 of the Registration of Births, Deaths and Marriages (Special Provisions) Act 1957[1] , is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows: Citation, commencement, interpretation 1.—(1) This Order may be cited as the Service Departments Registers (Amendment) Order 2005 and shall come into force on 7th December 2005. (2) In this Order "the 1959 Order" means the Service Departments Registers Order 1959[2]. Amendment of the 1959 Order 2.The 1959 Order shall be amended as follows— (1) In article 1(a) for the words "and marriages solemnised" there shall be substituted "marriages solemnised and civil partnerships formed". (2) In article 2(1) for the words "births and marriages" there shall be substituted "births, marriages and civil partnerships". (3) In article 2(2) for the words "births and marriages" there shall be substituted "births, marriages and civil partnerships". (4) In article 3(1) for the words "birth or marriage" there shall be substituted "birth, marriage or civil partnership". (5) In article 3(4)(c) there shall be inserted, immediately after sub-paragraph (c):
(6) In article 3(5) for the words "birth or marriage" there shall be substituted the words "birth, marriage or civil partnership". (This note is not part of the Order) The Registration of Births, Deaths and Marriages (Special Provisions) Act 1957 ("the 1957 Act") empowers Her Majesty to provide by Order in Council for the keeping of records of births, deaths and marriages relating to HM armed forces and associated civilians. The Services Departments Registers Order 1959 ("the 1959 Order") sets out the relevant provisions. Schedule 27 of the Civil Partnership Act 2004 amended the 1957 Act to extend the keeping of records to civil partnerships. This Order further amends the 1959 Order to make the necessary provision for the keeping of records of civil partnerships.
