The Criminal Procedure Rule Committee (Amendment of Constitution) Order 2005

The Lord Chancellor, in exercise of the powers conferred upon him by section 71 of the Courts Act 2003[1] and after consulting the Lord Chief Justice, hereby makes the following Order:

Citation and Interpretation
    1.This Order may be cited as the Criminal Procedure Rule Committee (Amendment of Constitution) Order 2005 and shall come into force on 14th October, 2005.

Amendment of section 70(2) of the Courts Act 2003
    2.Amend section 70(2)(b) of the Courts Act 2003 as follows—

    (a) omit the word "puisne", and

    (b) for the words "an ordinary" substitute "a".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends section 70(2)(b) of the Courts Act 2003 to make eligible for appointment to the Criminal Procedure Rule Committee any judge of the High Court or of the Court of Appeal.
