The Secretary of State, in exercise of the powers conferred by section 26(1) of the Transport and Works Act 1992[1] hereby makes the following Order: Citation, commencement and application 1.This Order may be cited as the Transport (Guided Systems)(England)(Amendment) Order 2005 and shall come into force on 12th September 2005. 2.This Order applies to England only. Amendment of the Transport (Guided Systems) Order 1992 3.—(1) The Transport (Guided Systems) Order 1992[2] shall be amended in accordance with the following provisions of this Order. (2) In article 3(1) the definition of "magnetic levitation" shall be omitted. (3) In the Schedule—
(b) in the entry relating to Stansted Airport, in the description of the terminal points, for "satellite 1" there shall be substituted "satellites 1 and 2", (c) for the entry relating to Birmingham International Airport there shall be substituted—
(This note is not part of the Order) The Transport (Guided Systems) Order 1992 specifies certain systems of guided transport for the purposes of Chapter I of Part II of the Transport and Works Act 1992. It accordingly has the effect of applying to those systems the provisions of that Act which introduce offences involving drink and drugs. This Order amends the Transport (Guided Systems) Order 1992. The principal amendments provide for—
(b) amending the description of a guided transport system at Stansted Airport to include its extension to satellite 2, (c) substituting a new guided transport system and amending the description of the termini at Birmingham International Airport, and (d) revising the reference to Birmingham International railway station and Birmingham International Airport to reflect the significant developments that have taken place at the location of both termini.
