The Secretary of State for Transport, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the regulation and supervision of the working conditions of persons engaged in road transport and the regulation of the type, description, construction or equipment of vehicles, in exercise of the powers conferred upon him by that provision, hereby makes the following Regulations: Citation, commencement and extent 1. - (1) These Regulations may be cited as the Passenger and Goods Vehicles (Recording Equipment) (Tachograph Card Fees) Regulations 2005 and shall come into force on 1st June 2005. (2) These Regulations extend to Great Britain. Interpretation 2. - (1) In these Regulations -
(b) Commission Regulation (EEC) No 3688/92[5]; (c) Commission Regulation (EC) No 2479/95[6] (d) Commission Regulation (EC) 1056/97[7]; (e) Article 1 of Commission Regulation (EC) 2135/98[8]; (f) Commission Regulation (EC) 1360/2002[9]; (g) Commission Regulation (EC) 432/2004[10]; and (h) any Regulations adopted in accordance with the procedure laid down in article 18 to the Community Recording Equipment Regulation making amendments necessary to adapt the Annexes to that Regulation to technical progress; and as read with the Community Drivers' Hours and Recording Equipment (Exemptions and Supplementary Provisions) Regulations 1986[11];
(2) Where any question arises as to whether a person is normally resident in Great Britain he shall be deemed to be normally resident there if he shows that he will have lived there for no fewer than 185 days during the period of 12 months ending on the day on which the tachographs card is to be issued.
(ii) the Community Recording Equipment Regulation; (b) satisfies the Secretary of State that he is normally resident within Great Britain;
(ii) in such form, and provides the Secretary of State with such documents and information in support of the application, as the Secretary of State may require; (d) save in the circumstances described in paragraph (3), does not hold a driver card; and (3) The circumstances referred to in paragraph (2)(d) are that the person
(ii) has applied to renew it not later than 15 working days before the date of expiry of his existing card. 4. - (1) The holder of a driver card may apply to exchange his driver card if the requirements in this regulation are satisfied.
(ii) complies with Annexes IB and II to that Regulation; (b) either -
(ii) if a company, has a place of business in Great Britain; (c) makes an application for the card in such form and provides the Secretary of State with such documents and information in support of the application as the Secretary of State may require; and Workshop cards and control cards
(ii) the holder is entitled to continue to hold the card; (b) surrenders the damaged or malfunctioning card to the Secretary of State; the Secretary of State shall issue a replacement card.
(b) replacement of a malfunctioning driver card or company card; or (c) a driver card issued with corrected personal details of the driver in exchange for an existing driver card. (5) When an application is made for a tachograph card, which, but for this paragraph, would attract more than one fee, only one fee shall be paid in respect of that card and where the fees are different, that fee shall be the higher or the highest of them.
(This note is not part of the Regulation) These Regulations provide for the issuing of driver cards, company cards, workshop cards and control cards for use with digital tachographs, which are tachographs complying with Annexes IB and II to Council Regulation (EEC) No.3821/85 on recording equipment in road transport, and for the replacement of cards which expire, are damaged, malfunction, are lost or are stolen. They provide for the payment of specified fees in respect of driver cards, which are held by drivers of vehicles required to be fitted with digital tachographs by the Community Recording Equipment Regulation, and company cards, which are held by the operators of such vehicles. No fees are payable in respect of workshop cards, which may be held by approved workshops only, or control cards which may be held by the police and officers of the Vehicle and Operator Services Agency (an agency of the Department for Transport) only. A Regulatory Impact Assessment has been produced and a copy placed in the library of both Houses of Parliament. Copies may be obtained from DVLA, Drivers Policy Group, 3 Sandringham Park, Swansea Vale, Swansea, SA7 0EP. Alternatively copies can be obtained from DVLA's website which is at www.dvla.gov.uk.
