The Public Order (Prescribed Forms) Regulations (Northern Ireland) 2005

The Secretary of State, in exercise of the powers conferred upon him by section 6(3) of the Public Processions (Northern Ireland) Act 1998[1] hereby makes the following Regulations:

Citation and commencement
    1.These Regulations may be cited as the Public Order (Prescribed Forms) Regulations (Northern Ireland) 2005 and shall come into force on 15th April 2005.

Notice of public processions and related protest meetings
    2.The form in the Schedule to these Regulations is hereby prescribed for the purposes of section 6(3)(a) of the Public Processions (Northern Ireland) Act 1998 (advance notice of pubic processions) in respect of any public procession held, or proposed to be held, on or after 14th May 2005.

Revocation
    3.Regulation 2(1) of the Public Order (Prescribed Forms) Regulations (Northern Ireland) 2004[2] is hereby revoked with effect from 14th May 2005.

EXPLANATORY NOTE

(This note is not part of the Order)


These Regulations prescribe the form for notice of a public procession as required by section 6(3) of the Public Processions (Northern Ireland) Act 1998 ("1998 Act"). They replace the form for notice of a public procession prescribed by the Public Order (Prescribed Forms) Regulations (Northern Ireland) 2004 (S.I. 2004/416).

The Public Processions (Amendment) (Northern Ireland) Order 2005 (S.I. 2005/857 (N.I. 2)) ("2005 Order") amended the 1998 Act to enable the Commission to issue determinations imposing conditions on persons supporting a public procession. Section 6(4)(c) of the 1998 Act, as amended by the 2005 Order, provides that the prescribed form shall require a person giving notice to specify the number of persons likely to support the procession as well as the number of persons likely to take part in it.

The principal change to the form prescribed in the Schedule (Notice of intention to organise a public procession) is that the organiser is required to specify the likely number of supporters.
