The Secretary of State for Work and Pensions, in exercise of the powers conferred upon him by paragraph 4(5) of Schedule 7 to the Social Security Contributions and Benefits Act 1992[1] and of all other powers enabling him in that behalf, hereby makes the following Order: Citation and commencement 1.This Order may be cited as the Social Security (Industrial Injuries) (Dependency) (Permitted Earnings Limits) Order 2005 and shall come into force on 13th April 2005. Increase of earnings limits in respect of dependent children 2.In paragraph 4(4) of Schedule 7[2] to the Social Security Contributions and Benefits Act 1992 -
(b) in paragraph (b), for the amount of Ј21 there shall be substituted the amount of Ј22 and for the amount of Ј165 there shall be substituted the amount of Ј170.
(This note is not part of the Order) Where a disablement pension with unemployability supplement is increased in respect of a child or children and the beneficiary is one of two persons who are spouses residing together or an unmarried couple, paragraph 4(4) of Schedule 7 to the Social Security Contributions and Benefits Act 1992 provides that the increase shall not be payable in respect of the first child if the other person's earnings are Ј165 a week or more and in respect of a further child for each complete Ј21 by which the earnings exceed Ј165. This Order increases the amounts of Ј165 to Ј170 and the amount of Ј21 to Ј22. A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
