Whereas, in exercise of their powers under section 32 of the Medical Act 1983[1] and of all other powers enabling it in that behalf, the General Medical Council has made the Medical Practitioners Registration (Fees) (Amendment) Regulations 2004 as set out in the Schedule to this Order: And whereas by section 32(8) of that Act, such regulations shall not come into force until approved by Order of the Privy Council: Now, therefore, Their Lordships, having taken these regulations into consideration, are pleased to, and do hereby approve them. This Order may be cited as the General Medical Council (Registration (Fees) (Amendment) Regulations) Order of Council 2004, and shall come into force on 1st January 2005. A. K. Galloway Clerk of the Privy Council The General Medical Council in exercise of their powers under section 32 of the Medical Act 1983, and of all other powers enabling them in that behalf, hereby make the following Regulations: Citation, commencement and interpretation 1. - (1) These Regulations may be cited as the Medical Practitioners Registration (Fees) (Amendment) Regulations 2004 and shall come into force on 1st January 2005. (2) In these Regulations "the principal Regulations" means the Medical Practitioners Registration (Fees) Regulations 1985[2]. Amendment of the principal Regulations 2.In regulation 2(1) of the principal Regulations the following definition shall be inserted after the definition of "due date" -
7.Where the Registrar is satisfied that a person's gross annual income in the current year or in the forthcoming registration year will be less than Ј19,700 he shall grant to that person a refund or a discount of one half of any fee which has been paid or would otherwise be payable by that person under regulation 4 or 5 in respect of the current year or the forthcoming registration year as appropriate." )This note is not part of the Order) The Regulations approved by this Order amend the Medical Practitioners Registration (Fees) Regulations 1985 (scheduled to S.I. 1986/149) so as to make provision for persons whose gross annual income is less than Ј19,700 to pay half the fee that would otherwise be payable on registration or retention of registration under the Medical Act 1983 or to seek a refund of that amount.
