CHILD TRUST FUNDS

The Child Trust Funds Act 2004 (Commencement No. 2) Order 2004

The Treasury, in exercise of the powers conferred upon them by section 27 of the Child Trust Funds Act 2004[1], make the following Order:

Citation and interpretation
1. - (1) This Order may be cited as the Child Trust Funds Act 2004 (Commencement No. 2) Order 2004.

(2) In this Order -

"the Act" means the Child Trust Funds Act 2004;

"the earlier Order" means the Child Trust Funds Act 2004 (Commencement No. 1) Order 2004)[2].

Commencement of provisions of the Act
    2. - (1) Sections 1 to 24 of the Act shall come into force on 6th April 2005, subject to the following paragraphs.

    (2) Paragraph (1) does not apply to provisions brought into force for all purposes by the earlier Order.

    (3) Section 23(1) of the Act shall come into force for all purposes on 1st January 2005.

    (4) Where a provision of the Act (other than section 23(1)) was partially brought into force by the earlier Order, that provision shall come into force for all other purposes on 6th April 2005.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings the main (and remaining) provisions of the Child Trust Funds Act 2004 into force on 6th April 2005 (which is the start date for child trust funds to operate). There has already been one Commencement Order (the Child Trust Funds Act 2004 (Commencement No. 1) Order 2004 (S.I. 2004/2422 (C. 103)) bringing transitional provisions into force on 1st January 2005.
