The Secretary of State, in exercise of the powers conferred upon him by section 71(5) of the Race Relations Act 1976[1] hereby makes the following Order: Citation and commencement 1.This Order may be cited as the Race Relations Act 1976 (General Statutory Duty) Order 2004 and shall come into force on 31st December 2004. Amendment of Schedule 1A to the Race Relations Act 1976 2.Schedule 1A to the Race Relations Act 1976[2] is amended as follows:
(ii) under the sub-heading "Regulatory, audit and inspection", at the end of the entry relating to The Engineering Council insert "(UK)"; and (iii) under the sub-heading "Other Bodies, etc", at the end of the entry relating to The Gas and Electricity Consumer Council insert "(Energywatch)"; (b) in Part III under the sub-heading "Education", for the entry relating to The National College of School Leadership substitute "The National College for School Leadership"; and
The Commission for Healthcare Audit and Inspection Independent Regulator of NHS Foundation Trusts The Commission for Social Care Inspection The Office of Communications (Ofcom) The Social Fund Commissioner of the Independent Review Service Bòrd na Gàidhlig (Alba) National Museum for Science and Industry Remploy Limited Royal Parks in England UK Sport Women's National Commission" (This note is not part of the Order) This Order amends the list of bodies and other persons specified in Schedule 1A to the Race Relations Act 1976 who, by virtue of section 71(1) of the Act, are subject to the general duty to have due regard, when exercising their functions, to the need to eliminate unlawful racial discrimination and to promote equality of opportunity and good relations between persons of different racial groups. The Order amends the names of three bodies which are already listed, removes from the list the other bodies mentioned in article 2(a) and (b) and adds to the list the other persons and bodies specified in the Schedule to the Order, thereby also subjecting those specified bodies and persons to the general duty.
