The International Criminal Tribunal for the Former Yugoslavia (Freezing of Funds and Economic Resources of Indictees) (Amendment) Regulations 2004

The Treasury are a government department designated[1] for the purpose of section 2(2) of the European Communities Act 1972[2] in relation to measures relating to (i) the interruption or reduction, in part or completely, of economic relations with one or more countries which are not Member States, and (ii) the movement of capital and payments, between Member States and between Member States and countries which are not Member States;

    The Treasury, in exercise of the powers conferred on them by that section, hereby make the following Regulations:

Citation and commencement
    1.These Regulations may be cited as the International Criminal Tribunal for the Former Yugoslavia (Freezing of Funds and Economic Resources of Indictees) (Amendment) Regulations 2004 and shall come into force on 25th November 2004.

Amendment to the International Criminal Tribunal for the Former Yugoslavia (Freezing of Funds and Economic Resources of Indictees) Regulations 2004
    2.At the end of the definition of "the EC Regulation" in regulation 1(2) of the International Criminal Tribunal for the Former Yugoslavia (Freezing of Funds and Economic Resources of Indictees) Regulations 2004[3] insert before the full stop - 

      " , as amended by Commission Regulation (EC) No 1965/2004 of 15th November 2004[4]".

EXPLANATORY NOTE

(This note is not part of the Regulations)


Council Regulation (EC) No 1763/2004 of 11th October 2004 (O.J No L.314, 14.10.2004, p.14) provided, among other matters, for a freeze on the funds of certain persons indicted by the International Criminal Tribunal for the Former Yugoslavia. These persons were listed in Annex 1 to that Regulation. Commission Regulation (EC) No 1965/2004 of 15th November 2004 substituted a revised version of Annex 1 in place of the original Annex 1.

The International Criminal Tribunal for the Former Yugoslavia (Freezing of Funds and Economic Resources of Indictees) Regulations 2004 (S.I.2004/2690) provide that breaches of certain provisions of Council Regulation (EC) No 1763/2004, and certain other acts and omissions, are to be criminal offences. The present Regulations amend those Regulations so that they refer to Council Regulation (EC) No 1763/2004 as amended by Commission Regulation (EC) No 1965/2004.

A full regulatory impact assessment has not been produced for this instrument, as it has no impact on the cost of business.
