The Motor Vehicles (Driving Licences) (Amendment) (No.3) Regulations 2004

The Secretary of State for Transport, in exercise of the powers conferred upon him by sections 89(4)(b) and 105(3) of the Road Traffic Act 1988[1], after consulting with representative organisations in accordance with section 195(2) of the Road Traffic Act 1988 and with the approval of the Treasury[2], hereby makes the following Regulations:

Citation and commencement
    1.These Regulations may be cited as the Motor Vehicles (Driving Licences) (Amendment) (No.3) Regulations 2004 and shall come into force on 8th December 2004.

Amendment of the Motor Vehicles (Driving Licences) Regulations 1999
    2.The Motor Vehicles (Driving Licences) Regulations 1999[3] are amended in accordance with regulations 3 and 4.

    3.In regulation 35 (fees in respect of practical or unitary tests) for paragraph (6) substitute - 

        "(6) For the purposes of this regulation and Schedule 5, a test - 

      (a) for a licence authorising the driving of a motor vehicle in category A, B, F, G , H K or P or subcategory A1 or B1 commences during normal hours if the time for which the test appointment is made is any time between 0730 hours and 1630 hours on a working day,

      (b) for a licence authorising the driving of a motor vehicle in any other category commences during normal hours if the time for which the test appointment is made is any time between 0830 hours and 1630 hours on a working day; and

      (c) commences out of hours, if the time for which the test appointment is made is at a time not specified above for the type of licence in question."

    4.For the table in Schedule 5 substitute the following table -

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations increase some of the fees payable under the Motor Vehicle (Driving Licences) Regulations 1999.

Regulation 4 amends the fees payable upon application for a practical or a unitary driving test where the application is made on or after the coming into force of these Regulations. The following tables show the new fees with the percentage increase in brackets. The fees were last increased on 14th November 2002.

Regulation 3 changes the times that represent "normal hours" for commencing a practical or unitary driving test.

These Regulations are made in conjunction with the Motor Cars (Driving Instruction) (Amendment) Regulations 2004.
