The Secretary of State, in exercise of the powers conferred upon her by section 29(1) of the Gangmasters (Licensing) Act 2004 [1], makes the following Order: Citation, commencement and interpretation 1. - (1) This Order may be cited as the Gangmasters (Licensing) Act 2004 (Commencement No. 1) Order 2004 and shall come into force on 1st December 2004. (2) In this Order -
Provisions coming into force
(b) section 2 (directions given to the Authority by the Secretary of State); (c) section 3 (work to which the 2004 Act applies); (d) section 4 (defining what is meant by "acting as a gangmaster"); (e) section 5 (defining the territorial scope of application of the 2004 Act); (f) section 6(2) (power to make regulations specifying when a licence is not required); (g) section 10 (power to make regulations establishing an appeals process); (h) section 25 (general provisions regarding regulations, rules and orders); (i) section 26 (meaning of "worker"); (j) section 28 (application of the 2004 Act to Northern Ireland) in so far as it relates to paragraphs 1 to 8, 11, 19 and 21 of Schedule 2; (k) section 30 (short title and extent); (l) Schedule 1 (consequential amendments); and (m) paragraphs 1 to 8, 11, 19 and 21 of Schedule 2.
