The Education (Assisted Places) (Incidental Expenses) (Amendment) (England) Regulations 2004

In exercise of the powers conferred on the Secretary of State by section 3(1) and (3) of the Education (Schools) Act 1997[1], the Secretary of State for Education and Skills hereby makes the following Regulations:

Citation, commencement and application
    1. - (1) These Regulations may be cited as the Education (Assisted Places) (Incidental Expenses) (Amendment) (England) Regulations 2004 and shall come into force on 1st September 2004.

    (2) These Regulations apply in relation to a school year beginning on or after that date.

    (3) These Regulations apply only in relation to England.

Amendment of the Education (Assisted Places) (Incidental Expenses) Regulations 1997
    2. - (1) The Education (Assisted Places) (Incidental Expenses) Regulations 1997[2] are amended as follows.

    (2) In regulation 2 - 

    (a) In paragraph (2), substitute "Ј12,846" for "Ј12,508".

    (b) In paragraph (3) for sub-paragraphs (a) and (b) substitute - 

      " (a) Ј79 where the relevant income does not exceed Ј11,935; and

      (b) Ј41 where that income exceeds Ј11,935 but does not exceed Ј12,846".

    (3) In regulation 4  - 

    (a) in paragraph (3), substitute "Ј11,948" for "Ј11,639"; and

    (b) in paragraph (4) - 

      (i) substitute "Ј11,948" for "Ј11,639"; and

      (ii) substitute "Ј11,769" for "Ј11,460".

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations further amend the Education (Assisted Places) (Incidental Expenses) Regulations 1997 ("the 1997 Regulations") in respect of the school year beginning on or after 1st September 2004. The 1997 Regulations provide for the payment of grants as regards incidental expenses, and for the remission of incidental expenses, in respect of pupils eligible to continue to hold assisted places by virtue of section 2 of the Education (Schools) Act 1997, notwithstanding the abolition of the assisted places scheme by section 1 of that Act.

These Regulations amend the means test (set out in regulation 2 of the 1997 Regulations) for determining eligibility to uniform grant and increase the amount of such grant payable in respect of clothing expenditure incurred in relation to the 2004/2005 and subsequent school years. Ј79 (instead of Ј77 as previously) is payable where the relevant income does not exceed Ј11,935 (instead of Ј11,626) and Ј41 (instead of Ј40) is payable where the relevant income exceeds that figure but does not exceed Ј12,846 (instead of Ј12,508).

These Regulations also amend the means test (set out in regulation 4 of the 1997 Regulations) for determining eligibility to travel grant and increase the amount of grant payable in respect of school travel expenditure in relation to the 2004/2005 and subsequent school years. Where the relevant income does not exceed Ј11,948 (instead of Ј11,639), travel grant shall be of an amount equal to the school travel expenditure to which it relates. Where the relevant income exceeds that sum, travel grant will be of the amount, if any, by which the school travel expenditure to which it relates exceeds an amount (rounded down to the nearest multiple of Ј3) equal to one-twelfth of that part of the relevant income which exceeds Ј11,769 (instead of Ј11,460).
