The National Assembly for Wales makes the following Regulations in exercise of the powers conferred on the Secretary of State by section 3(3), (4), (5) and (9) of the Education (Schools) Act 1997[1] and now vested in the National Assembly for Wales[2]: Name, commencement and application 1. - (1) These Regulations are called the Education (Assisted Places) (Incidental Expenses) (Amendment) (Wales) Regulations 2004 and come into force on 1st September 2004. (2) These Regulations apply to Wales only. (3) These Regulations apply in relation to any school year beginning on or after 1st September 2004. Amendment of the Education (Assisted Places) (Incidental Expenses) Regulations 1997 2. - (1) The Education (Assisted Places) (Incidental Expenses) Regulations 1997[3] are amended as follows. (2) In regulation 2(2), for "Ј12,508" there is substituted "Ј12,846". (3) For regulation 2(3)(a) and (b) there is substituted -
(b) Ј41 where that income exceeds Ј11,935 but does not exceed Ј12,846.". (4) In regulation 4 -
(b) in paragraph (4) -
(ii) for "Ј11,460" there is substituted "Ј11,769".
(This note is not part of the Regulations) These Regulations amend the Education (Assisted Places) (Incidental Expenses) Regulations 1997 ("the 1997 Regulations") in respect of a school year beginning on or after 1st September 2004. The 1997 Regulations provide for the payment of grants as regards incidental expenses, and for the remission of incidental expenses, in respect of pupils eligible to continue to hold assisted places at independent schools by virtue of section 2 of the Education (Schools) Act 1997, notwithstanding the abolition of the assisted places scheme by section 1 of that Act. These Regulations relax the means test (set out in regulation 2 of the 1997 Regulations) and increase the amount of grant payable for uniform grant in respect of clothing expenditure incurred in relation to the 2004/2005 and subsequent school years. These Regulations also relax the means test (set out in regulation 4 of the 1997 Regulations) for travel grant and increase the amount of grant payable. Notes: [1] 1997 c.59.
