The Secretary of State for Education and Skills, in exercise of the powers conferred on him by sections 22(1) and (2), 42(6) and 43(1) of the Teaching and Higher Education Act 1998[1], hereby makes the following Regulations: Citation, commencement, interpretation and application 1.These Regulations may be cited as the Education (Grants for Disabled Postgraduate Students) (Amendment) Regulations 2004 and shall come into force on 1st September 2004. 2.In these Regulations, "the 2000 Regulations" means the Education (Grants for Disabled Postgraduate Students) Regulations 2000[2]. 3.The 2000 Regulations shall be amended in accordance with regulations 5, 6 and 7. 4.These Regulations shall not have effect in relation to an academic year (as defined in regulation 2(6) of the 2000 Regulations) which begins before 1st September 2004. Amendment of the 2000 Regulations 5. - (1) Amend regulation 2 as follows. (2) In paragraph (1), for the definition of "Research Council or similar body" substitute -

(b) omit sub-paragraph (b). 6.In regulation 3(2)(a)(iii), for "similar body" substitute "the Arts and Humanities Research Board". (This note is not part of the Regulations) These Regulations further amend the Education (Grants for Disabled Postgraduate Students) Regulations 2000 ("the 2000 Regulations"). Regulation 3(2)(a)(iii) of the 2000 Regulations is amended so that it no longer excludes from grant eligibility students who are in receipt of any allowance, bursary or award of similar description from the British Academy (regulation 6). Consequential amendments are made to paragraphs (1) and (7) of regulation 2 (regulation 5). Regulation 9(2) is amended to increase the maximum level of fee grant from Ј5,370 to Ј5,500 (regulation 7). These amendments to the 2000 Regulations shall not apply in respect of an academic year beginning before 1st September 2004 (regulation 4). A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of businesses, charities or voluntary organisations. Notes: [1] 1998 c. 30.
