The Secretary of State, in exercise of the powers conferred upon him by sections 34(1) and 74(1) of the Railways and Transport Safety Act 2003[1], and having consulted in accordance with section 34(5) of that Act, hereby makes the following Order: Citation and commencement 1.This Order may be cited as the British Transport Police (Police Services Agreement) Order 2004 and shall come into force on 1st July 2004. Requirement to enter into a police services agreement 2. - (1) A person -
(ii) a train used on a network for the purpose of carrying goods; (iii) a light maintenance depot; or (iv) a station, and (b) who has been granted a licence pursuant to section 8 of the Railways Act 1993[2] authorising him to be the operator of the train, light maintenance depot or station in question, shall enter into a police services agreement. (This note is not part of the Order) 1.This order requires a person described in article 2(1) and Network Rail Infrastructure Limited to enter into a police services agreement; (see section 33 of the Railways and Transport Safety Act 2003 which contains provisions about a police services agreement). 2.A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
