The First Secretary of State, in exercise of the powers conferred upon him by section 36(2) of the Representation of the People Act 1983[1] and after consulting the Electoral Commission pursuant to section 7(2)(e) of the Political Parties, Elections and Referendums Act 2000[2], hereby makes the following Rules:

Citation, commencement and extent
    1. - (1) These Rules may be cited as the Local Elections (Parishes and Communities) (Amendment) (No. 2) (England and Wales) Rules 2004.

    (2) These Rules come into force on 30th April 2004.

    (3) These Rules extend to England and Wales.

Amendment of parishes and communities rules
    2. - (1) The rules in Schedule 3 to the Local Elections (Parishes and Communities) Rules 1986[3] shall be amended as follows.

    (2) In the Appendix of Forms - 

    (a) in the Directions as to printing the ballot paper, in paragraph 2(b), after the words "particulars of the candidates", insert "and the horizontal rules separating the particulars of the candidates"; and

    (b) in the form of candidate's consent to nomination, in paragraph (d), after the words "resided in that parish or community", insert "or within 4.8 kilometres of it".

EXPLANATORY NOTE

(This note is not part of the Rules)


These Rules correct two errors in Schedule 3 to the Local Elections (Parishes and Communities) Rules 1986, which was inserted by the Local Elections (Parishes and Communities) (Amendment) (England and Wales) Rules 2004. The errors involve the omission of a few words from the form of candidate's consent to nomination and from the directions as to how ballot papers are to be printed.
