The Secretary of State for Environment, Food and Rural Affairs being designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred upon her by that section, hereby makes the following Regulations: Title and commencement 1.These Regulations may be cited as the Evaluation of Active Substances for Pesticides (Fees) (Amendment) Regulations 2004 and shall come into force on 1st April 2004. Amendment of the Evaluation of Active Substances for Pesticides (Fees) Regulations 2000 2. - (1) The Evaluation of Active Substances for Pesticides (Fees) Regulations 2000[3] shall be amended in accordance with this regulation. (2) After regulation 2 there shall be added the following new regulations:
4. - (1) The fee, in relation to an active substance for which the United Kingdom is neither rapporteur nor co-rapporteur, for -
(b) assisting the European Food Safety Authority in its evaluation of the draft assessment report, and (c) considering the Commission's draft directive or decision, in accordance with Article 8 of Commission Regulation (EC) No. 451/2000 shall be Ј5,000 payable by the notifier to the United Kingdom in the same way as applies to the United Kingdom as rapporteur under regulation 2(2).
(This note is not part of the Regulations) These Regulations are made under section 2(2) of the European Communities Act and amend the Evaluation of Active Substances for Pesticides (Fees) Regulations 2000. The Regulations set a fee of Ј10,000 for the evaluation of a dossier submitted in accordance with Article 6 of Commission Regulation (EC) No. 451/2000 where the United Kingdom has been requested to act as co-rapporteur Member State under 8(2) of that Regulation. The Regulations also set a fee of Ј5,000 for work carried out by the United Kingdom in accordance with Article 8 Commission Regulation (EC) No. 451/2000: to provide the technical and scientific assistance to help a rapporteur Member State to evaluate a dossier submitted in accordance with Article 6 of that Regulation and the European Food Safety Authority to evaluate the rapporteur Member State's draft assessment report; and to consider the Commission's draft directive or decision under paragraph (8) of that Article. A Regulatory Impact Assessment has been prepared and placed in the library of each House of Parliament.
