The Architects (Professional Conduct Committee) Amendment Order 2004

The Secretary of State, in exercise of the powers conferred upon him by paragraph 24 of Schedule 1 to the Architects Act 1997[1] and after consultation, as required by that paragraph, with the Architects Registration Board and such other persons or bodies as he considered fit, hereby makes the following Order:

Citation and commencement
    1.This Order may be cited as the Architects (Professional Conduct Committee) Amendment Order 2004 and shall come into force on 1st April 2004.

Amendment of Act
    2.The Architects Act 1997, "the Act", is amended in accordance with articles 3 and 4.

Membership of Professional Conduct Committee
    3.For paragraph 13 of Schedule 1 to the Act (the Architects Registration Board and its committees), substitute - 

        " 13.The Professional Conduct Committee shall consist of - 

      (a) four elected members of the Board;

      (b) three appointed members of the Board;

      (c) three persons nominated by the President of the Law Society; and

      (d) six persons appointed by the Board, including three registered persons, of whom the address of at least one in the Register is in Scotland."

Quorum of the Professional Conduct Committee
    4. - (1) Paragraph 15 of Schedule 1 to the Act is amended as follows.

    (2) For sub-paragraph (1), substitute - 

        " (1) Subject to sub-paragraphs (1A) and (2), the quorum of the Professional Conduct Committee shall be one person nominated by the President of the Law Society; and any two persons from one or more of the following categories - 

      (a) the elected members of the Board;

      (b) the appointed members of the Board;

      (c) the persons appointed by the Board.

        (1A) The Committee shall not, however, be quorate unless there are present - 

      (a) a member of the Committee who is a registered person; and

      (b) a member of the Committee who is neither a registered person nor a person nominated by the President of the Law Society."

    (3) In paragraph (2), at the beginning insert, "In addition,".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends paragraphs 13 and 15 of Schedule 1 to the Architects Act 1997 by changing the membership of the Professional Conduct Committee and the rules as to quorum. A full regulatory impact assessment has not been produced for this instrument, as it has no impact on the costs of businesses, charities or voluntary bodies.
