The Secretary of State for Health, in exercise of the powers conferred upon him by section 126(3) of the National Health Service Act 1977[1], and by section 5(1) of, and paragraphs 1 and 3 of Schedule 2 to, the National Health Service and Community Care Act 1990[2], and of all other powers enabling him in that behalf, hereby makes the following order: Citation, commencement and interpretation 1. - (1) This Order may be cited as the Bradford Hospitals National Health Service Trust (Change of Name) and (Establishment) Amendment Order 2003 and shall come into force on 1st April 2003. (2) In this Order -
Change of name of the Trust
(b) In article 2 of the Establishment Order, the words "Bradford Hospitals" shall be replaced by "Bradford Teaching Hospitals".
(b) be taken as invalidating any instrument (whether made before, on, or after the day on which this Order comes into force) which refers to the trust by its previous name, and all instruments and other documents which refer to the trust under its previous name shall be construed as referring to it under its new name.
(2) Since the trust is to be regarded as having a significant teaching commitment within the meaning of paragraph 3(1)(d) of Schedule 2 to the Act, one of the non-executive directors shall be appointed from Leeds University.".
(This note is not part of the Order) This Order amends the Bradford Hospitals National Health Service Trust (Establishment) Order 1990, which established the Bradford Hospitals National Health Service Trust. Article 2 of the Order changes the name of the trust from the Bradford Hospitals National Health Service Trust to the Bradford Teaching Hospitals National Health Service Trust, and makes consequential amendments to the Establishment Order. Article 4 increases the number of non-executive directors from 5 to 6 and requires that one of them must be appointed from Leeds University to reflect the Trust's teaching commitment.
