The Copyright (Application to Other Countries) (Amendment) Order 2003

The Queen's Most Excellent Majesty in Council
Her Majesty, by and with the advice of Her Privy Council, and by virtue of the authority conferred upon Her by section 159 of the Copyright, Designs and Patents Act 1988[1], is pleased to order, and it is hereby ordered as follows - 

    1. - (1) This Order may be cited as the Copyright (Application to Other Countries) (Amendment) Order 2003 and shall come into force on 22nd April 2003.

    (2) In this Order "the Principal Order" means the Copyright (Application to Other Countries) Order 1999[2].

    2. - (1) Schedule 1 to the Principal Order shall be amended as follows.

    (2) The following shall be inserted into the list of entries in proper alphabetical order:

Armenia

Cambodia (27th September 1957)

Jordan

Oman

Sudan

Tonga

    (3) The words "Kampuchea (27th September 1957)" shall be omitted.

    (4) After the word "Taiwan", the date "(10th July 1985)" shall be omitted.

    (5) After the word "Tajikistan", the date "(25th December 1991)" shall be omitted.

    3.Schedule 2 to the Principal Order shall be amended by inserting the following into the list of entries in proper alphabetical order:

Albania

Armenia

Croatia

Dominica

Estonia

Israel

Latvia

Liechtenstein

Lithuania

Nicaragua

Ukraine.

    4. - (1) Schedule 3 to the Principal Order shall be amended as follows.

    (2) The following shall be inserted into the list of entries in proper alphabetical order:

Albania (1st September 2000)

Armenia (31st January 2003)

*China (11th December 2001)

Croatia (20th April 2000)

Estonia (13th November 1999)

*Georgia (14th June 2000)

*Jordan (11th April 2000)

Lithuania (22nd July 1999)

*Oman (9th November 2000)

*Taiwan (1st January 2002)

Ukraine (12th June 2002).

    (3) The asterisk before each of the following entries shall be omitted:

Dominica

Israel

Latvia

Liechtenstein

Nicaragua.

    (4) After the words "United States" there shall be inserted "of America".

    5.Paragraph 2 of Schedule 5 to the Principal Order shall be omitted.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Copyright (Application to Other Countries) Order 1999 (S.I. 1999/1751) ("the Principal Order"). The Principal Order applies or continues to apply the provisions of Part 1 of, and Schedule 1 to, the Copyright, Designs and Patents Act 1988 to works of different types originating in the countries specified in the Schedules to the Principal Order with the effect that those works receive or continue to receive copyright protection in the United Kingdom.

In particular this Order amends the Schedules to the Principal Order to take into account the accession of:

(a) Armenia, Jordan, Oman, Sudan, Tajikistan and Tonga to the Berne Copyright Convention (Cmnd. 5002);

(b) Albania, Armenia, Croatia, Dominica, Estonia, Israel, Latvia, Liechtenstein, Lithuania, Nicaragua and Ukraine to the Rome Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organisations (Cmnd. 2425); and

(c) China, Estonia, Georgia, Jordan, Oman and Taiwan to the Agreement establishing the World Trade Organisation (Cmnd. 2556-59, 2561-69, 2571-74) including the Agreement on Trade Related Aspects of Intellectual Property Rights.

Minor modifications are also made to correct references to certain countries listed in Schedules 1 and 3 of the Principal Order.
