The Products of Animal Origin (Third Country Imports) (Wales) (Amendment) Regulations 2002

The National Assembly for Wales, being designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, acting in exercise of the powers conferred by that section, makes the following Regulations:

Citation, commencement and application
    1.These Regulations may be cited as the Products of Animal Origin (Third Country Imports) (Wales) (Amendment) Regulations 2002, will come into force on 7th December 2002 and apply to Wales only.

Amendment to the Products of Animal Origin (Third Country Imports) (Wales) Regulations 2002
    2. - (1) Schedule 2 to the Products of Animal Origin (Third Country Imports) (Wales) Regulations 2002[3] (import conditions) is amended in accordance with paragraphs (2) and (3).

    (2) The following heading is substituted for the heading to Part V (fresh poultry meat) -

FRESH POULTRY MEAT, POULTRY MEAT PRODUCTS AND POULTRY MEAT PREPARATIONS

(3) The following section is inserted immediately after section D (health certification requirements) of Part V -

E. Protective measures - fresh poultry meat, poultry meat products and poultry meat preparations

EXPLANATORY NOTE

(This note is not part of the Regulation)

These Regulations amend Part V of Schedule 2 to the Products of Animal Origin (Third Country Imports) (Wales) Regulations 2002 (S.I. 2002/1387 (W.136)) in order to give effect in Wales to Commission Decision 2002/794/EC concerning certain protective measures with regard to poultry meat, poultry meat products and poultry meat preparations intended for human consumption and imported from Brazil (OJ No. L276, 12.10.2002, p.66).

These Regulations also correct an earlier defect in S.I. 2002/1387 (W.136) by including in Part V of Schedule 2 to that instrument a reference to Commission Decision 2002/251/EC concerning certain protective measures with regard to poultry meat and certain fishery and aquaculture products intended for human consumption and imported from Thailand (OJ No. L84, 28.3.2002, p.77). That Decision is already listed in section H of Part IX of Schedule 2 (protective measures - fishery products).

The Products of Animal Origin (Third Country Imports) (Wales) Regulations 2002 implement for Wales Council Directive 97/78/EC laying down the principles governing the organisation of veterinary checks on products entering the Community from third countries (OJ No. L24, 30.1.98, p.9).

The products to which S.I. 2002/1387 (W.136) applies are defined in regulation 2(1) of and Schedule 3 to that instrument.

Schedule 2 to S.I. 2002/1387 (W.136) lays down the conditions, by reference to the Community legislation listed in it, for the import of those products into Wales from third countries.

No regulatory appraisal has been prepared in relation to these Regulations.

These Regulations have been made in English only as, given the urgency with which they have had to be made, it was not reasonably practicable in the time available to produce a Welsh text.
