The Immigration (Short-term Holding Facilities) Regulations 2002

The Secretary of State, in exercise of the powers conferred upon him by section 157(1) of the Immigration and Asylum Act 1999[1], hereby makes the following Regulations:

Citation and commencement
    1.These Regulations may be cited as the Immigration (Short-term Holding Facilities) Regulations 2002 and shall come into force on 4th November 2002.

Extension of section 149 of the Immigration and Asylum Act 1999 to short-term holding facilities
    2.Section 149 of the Immigration and Asylum Act 1999 (contracting out of certain detention centres) is hereby extended to short-term holding facilities.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations extend section 149 of the Immigration and Asylum Act 1999, which provides for the contracting out of certain detention centres, to short-term holding facilities. This enables the Secretary of State to enter into a contract with another person for the provision or running (or the provision and running) by him, or (if the contract so provides) for the running by sub-contractors of his, of any short-term holding facility or part of a short-term holding facility.
