The Public Service Vehicles (Operators' Licences) (Fees) (Amendment) Regulations 2002

The Secretary of State for Transport, in exercise of the powers conferred by sections 52(1) and 60(1)(e) and (1A) of the Public Passenger Vehicles Act 1981[1], and after consultation with representative organisations in accordance with section 61(2) of that Act, hereby makes the following Regulations: - 

Citation and commencement
    1.These Regulations may be cited as the Public Service Vehicles (Operators' Licences) (Fees) (Amendment) Regulations 2002 and shall come into force on 1st November 2002.

Amendment to fees
    2. - (1) The Public Passenger Vehicles (Operators' Licences) (Fees) Regulations 1995[2] ("the principal Regulations") are amended as provided in paragraphs (2) and (3) below.

    (2) For regulation 3(4)(b) there is substituted - 

      " (b) in relation to fee number (vi) in column 1 a fee shall be paid by that licence holder, either annually or in respect of a period of less than a year, in accordance with the prescribed stipulations in column 5".

    (3) For the Schedule there is substituted the Schedule to these Regulations.

Transitional provisions
    3. - (1) Where a decision has been made before 1st November 2002 on an application for the grant of a standard or restricted licence under section 14(1) of the Public Passenger Vehicles Act 1981[3], the fee prescribed by the principal Regulations applies notwithstanding that the period of 21 days within which it is payable has not expired before that date.

    (2) Notwithstanding that the fee for the continuation in force of an existing standard or restricted licence may, under the provisions of the principal Regulations, be paid before the expiry of the relevant period of 5 years specified therein, where that period expires on or after 1st November 2002, the fee payable shall be the fee prescribed in these Regulations.

(iii)Grant of a standard or restricted licence under section 14(1) of the 1981 Act.Ј105Before the expiry of the period of 21 days beginning with the date the decision was made on the application for the grant of a licence.A first payment of Ј21 shall be made before the expiry of the period of 21 days beginning with the date the decision was made on the application for the grant of a licence and four subsequent annual payments of Ј21 shall be made on the anniversary of that date.
(iv)Continuation in force of an existing standard or restricted licence.Ј105Before the expiry of a period of 5 years beginning with the date of either the granting of the licence or the most recent 5 year anniversary of that date, whichever is the later.A first payment of Ј21 shall be made before the expiry of a period of 5 years beginning with the date of either the grant of the licence or the most recent 5 year anniversary of that date, whichever is the later, and four subsequent annual payments of Ј21 shall be made on the annivesary of that date.
(v)Application to vary a condition on a licence under section 16(6) of the 1981 Act so as to increase the maximum number of vehicles which may be used at any one time.[5]Ј79With the application for variation. 
(vi)Issue of a disc under section 18 of the 1981 Act.A sum equal to Ј4.50 multiplied by the number of whole months and part months during which the disc is expressed to be in force.Before the disc is issued.A sum equal to Ј5.25 multiplied by the number of whole months and part months during which the disc is expressed to be in force, to be paid before the disc is issued.
(vii)Application by the holder of a taxi licence for a restricted operator's licence under section 12 of the 1985 Act[6] (a "special licence").Ј42With the application for the grant of the licence.    
(viii)Continuation in force of an existing special licence.Ј42Before the expiry of a period of 5 years beginning with the date of either the grant of the licence or the most recent 5 year anniversary of that date, whichever is the later.    
(ix)Issue of a new disc in place of one lost or destroyed.Ј11 per disc.With the application.    



EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations replace the Schedule to the Public Service Vehicles (Operators' Licences) (Fees) Regulations 1995 with a Schedule incorporating new fees in respect of most items.

The Regulations also - 

    contain transitional provisions in respect of fees for the grant and continuation in force of standard and restricted operators' licences, and

    make minor changes to the provisions about vehicle discs which are issued for a period of a year or less under regulation 11 of the Public Service Vehicles (Operators' Licences) Regulations 1995 (S.I. 1995/2908).

The Regulations have been made in conjunction with the Community Bus (Amendment) Regulations 2002, the Minibus and other Section 19 Permit Buses (Amendment) Regulations 2002 and the Public Service Vehicles (Registration of Local Services) (Amendment) (No. 2) (England and Wales) Regulations 2002. A combined Regulatory Impact Assessment for these instruments has been prepared and copies can be obtained from the Buses and Taxis Division of the Department for Transport, Zone 3/13 Great Minster House, 76 Marsham Street, London SW1P 4DR (telephone number 020 7944 2275) or viewed on the Department for Transport website www.dft.gov.uk.
