The Secretary of State, in exercise of the powers conferred on him by sections 2 and 2A(3) of the Police (Property) Act 1897[1] hereby makes the following Regulations: Citation and commencement 1. - (1) These Regulations may be cited as the Police (Property) (Amendment) Regulations 2002 and shall come into force on 1st October 2002. (2) In these Regulations "the 1997 Regulations" means the Police (Property) Regulations 1997[2]. Amendments to the 1997 Regulations 2.There shall be inserted after regulation 3(a) of the 1997 Regulations:
3.In regulation 5(1) of the 1997 Regulations for the words "section 43 of the Powers of Criminal Courts Act 1973" there shall be substituted "section 143 of the Powers of Criminal Courts (Sentencing) Act 2000". (This note is not part of the Regulations) These Regulations amend the Police (Property) Regulations 1997 ("the 1997 Regulations"). Section 77 of the Police Reform Act 2002 applied the Police (Property) Act 1897 to the National Crime Squad. These Regulations make a number of consequential amendments to the 1997 Regulations. References to the Powers of Criminal Courts Act 1973 have been replaced with references to the Powers of Criminal Courts (Sentencing) Act 2000 which repealed and consolidated the 1973 Act. Notes: [1] 1897 c. 30; section 2 was amended by section 1 of the Police (Property) Act 1997 (c. 30) and section 77 of the Police Reform Act 2002 (c. 30) and was extended by section 144(2), (3) and (4) of the Powers of Criminal Courts (Sentencing) Act 2000 (c. 6).
