Whereas the review body appointed under section 1(1) of the School Teachers' Pay and Conditions Act 1991[1] ("the Act") have made a report following the reference to them of certain matters; And whereas the Secretary of State has consulted, in accordance with section 2(1) of the Act[2], such associations of local education authorities, such bodies representing the interests of governors of foundation, voluntary and foundation special schools and such bodies representing school teachers as appeared to him to be concerned; Now, therefore, the Secretary of State, in exercise of the powers conferred by sections 2(1), (3) and (4) and 5(4) of the Act[3]hereby makes the following Order: Citation and commencement 1.This Order may be cited as the Education (School Teachers' Pay and Conditions) (No.2) Order 2001 and shall come into force on 1st April 2001. Application 2.This Order applies to school teachers (as defined in section 5(1) and (2) of the School Teachers' Pay and Conditions Act 1991[4] in England and Wales. School Teachers' Pay and Conditions 3.The School Teachers' Pay and Conditions Document 2000[5] shall be amended with effect from 1st April 2001 as follows. 4.For paragraphs 4.1 to 4.3 there shall be substituted the following paragraphs -
4.2 From 1st April 2001 a deputy head teacher shall be paid such salary based upon the leadership group pay spine set out in paragraph 4.5 as the relevant body shall determine in accordance with paragraph 12 or 13. 4.3 From 1st April 2001 and assistant head teacher shall be paid such salary based upon the leadership group pay spine set out in paragraph 4.5 as the relevant body shall determine in accordance with paragraph 15.". 5.For the table in paragraph 4.5 there shall be substituted the following table -

Management allowances form 1st April 2001
Recruitment and retention allowances from 1st April 2001
21.2.1 The relevant body shall determine when making an award under paragraph 21.1 whether the allowance should be awarded for a fixed period of time or that it is to be retained while the classroom teacher remains in the same post. 21.2.2 The relevant body may review the award of an allowance under paragraph 21.1 and paragraph 21.2.1 at any time, but where the review takes place before the expiry of the fixed period of time for which the allowance was awarded or, as the case may be, while the classroom teacher is in the post in respect of which the allowance was awarded, they may not determine that a lower allowance should be awarded under paragraph 21.1 and paragraph 21.2.1 or that the allowance should be withdrawn. 21.2.3 Where the relevant body determines that a classroom teacher who holds a recruitment and retention allowance awarded under paragraph 21.1 and paragraph 21.2.1 while he remains in the same post should be awarded a higher recruitment and retention allowance which is awarded for a fixed period, that teacher shall retain his original recruitment and retention allowance while he remains in the same post if the higher recruitment and retention allowance is subsequently withdrawn following the expiry of the fixed period. 21.2.4 Where in accordance with paragraph 21.4 of the 2000 Document the relevant body first review the award of a recruitment and retention allowance which was made under paragraph 21 of that Document, they may determine to withdraw the allowance or to replace it with an allowance or allowances under this paragraph. 21.3 The relevant body may for the current or previous pay year award a recruitment and retention allowance, or part of such allowance, in the form of a lump sum. 21.4.1 With effect from 1st April 2001, the relevant body may award a classroom teacher a recruitment and retention allowance, or part of such allowance, in the form of a lump sum payable at the end of a period of unbroken employment at the same school or in the case of an unattached teacher with the same authority. 21.4.2 The period of unbroken employment referred to in paragraph 21.4.1 shall not -
(b) exceed three years. 21.4.3 An award under paragraph 21.4.1 may if the teacher agrees replace in whole or in part an existing award of a recruitment and retention allowance. 13.For paragraph 22.1 there shall be substituted the following paragraph -
14. - (1) In paragraph 29.3.3 -
(b) for "Ј500" wherever it occurs there shall be substituted "Ј250". (2) After paragraph 29.3.4 there shall be inserted the following paragraph -
15.For paragraph 31.1 there shall be substituted the following paragraph -
Pay spine from 1st April 2001
Pay scale from 1st April 2001
(b) if he is serving in the Outer London Area, Ј1,974 per annum from 1st April 2001; and (c) if he is serving in the Fringe Area, Ј765 per annum from 1st April 2001.". 18. - (1) In paragraph 40.4 (a) (ii) after "paragraphs 20 to 22" there shall be inserted "except for an allowance payable pursuant to an award under paragraph 21.4.1".
46A.1 The relevant body, and where they are the teacher's employers the authority, may as an incentive for the recruitment of new teachers and the retention in their service of existing teachers make payments or provide other financial assistance, support or benefits to a teacher for the purposes set out in paragraph 46A.2. 46A.2 The purposes are to assist the teacher with -
(b) relocation expenses incurred by him; or (c) travel expenses incurred in connection with his journey to and from his place of work.".
(This note is not part of the Order) This Order amends the School Teachers' Pay and Conditions Document 2000 by uprating the amounts of salary and certain allowances. The following are increased -
(b) the classroom teachers' pay scale set out in paragraph 17 of the Document; (c) the upper pay scale for post-threshold teachers set out in paragraph 19 of the Document; (d) management, recruitment and retention and special educational needs allowances for classroom teachers set out in paragraphs 20 to 22 of the Document; (e) the advanced skills teachers' pay spine set out in paragraph 31 of the Document; (f) the unqualified teachers' pay scale set out in paragraph 32 of the Document; and (g) the London Area allowances set out in paragraph 37 of the Document. The increases are from 1st April 2001.
