The Secretary of State, in exercise of the powers conferred on him by sections 31(1) and 198(2) of the Licensing Act 1964[1], hereby makes the following Order: 1.This Order may be cited as the Order Prescribing Forms under the Licensing Act 1902 (Amendment) Order 2001 and shall come into force on 1st April 2001. 2. - (1) The Order of the Secretary of State, dated 28th October 1902, prescribing Forms under the Licensing Act 1902[2] shall be amended in accordance with paragraph (2). (2) In the Particulars of the Notice of Conviction in the Appendix to the above-mentioned Order, for the words "Clerk to the justices" there shall be substituted the words "Chief Executive to the Justices". Parliamentary Under-Secretary of State Mike O'Brien Home Office 20th March 2001 (This note is not part of the Order) This Order amends the Order of the Secretary of State, dated 28th October 1902, prescribing Forms under the Licensing Act 1902 to transfer the functions of the justices' clerks under the Order to justices' chief executives. It is consequential on an amendment to section 31 of the Licensing Act 1964 (which re-enacts the provision in the Licensing Act 1902 under which the amended Order was made) made by Schedule 13 to the Access to Justice Act 1999.
