The A249 Trunk Road (Iwade Bypass to Neatscourt Roundabout and Bridge) Order 2000

The Secretary of State for the Environment, Transport and the Regions makes this Order in exercise of powers conferred by sections 10, 41 and 106 of the Highways Act 1980[1] and now vested in him[2], and of all other powers enabling him in that behalf: - 

    1. - (1) This Order may be cited as the A249 Trunk Road (Iwade Bypass to Neatscourt Roundabout and Bridge) Order 2000 and shall come into force on 19th October 2000.

    (2) In this Order measurements of distance are measured along the route of the relevant highway.

    2.The new highway which the Secretary of State proposes to construct along the routes described in Schedule 1 to this Order shall become a trunk road from the date when this Order comes into force.

    3.The centre line of the new trunk road is indicated by a heavy black line on the plan numbered HA 10/1/SWD/129 marked "The A249 Trunk Road (Iwade Bypass to Neatscourt Roundabout and Bridge) Order 2000" signed by authority of the Secretary of State for the Environment, Transport and the Regions and deposited at the Highways Agency, St. Christopher House, Southwark Street, London SE1 0TE.

    4.The Secretary of State directs as respects any part of a highway which crosses the route of the new trunk road that - 

    (a) where the highway is maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority; and

    (b) where the highway is not so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure, or prescription, the Secretary of State shall be under no duty to maintain the part in question,

until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the new trunk road is opened for traffic.

    5.The Secretary of State is authorised to construct the bridge specified in Schedule 2 to this Order as part of the new trunk road, over the part of the navigable watercourse specified in that Schedule.

SCHEDULE 1
    
ROUTES OF THE NEW TRUNK ROAD



      (i) A route being about 1.7 kilometres in length and marked "1" on the plan, from a point on the A249 Iwade Bypass about 400 metres south of the centre of the A249 Iwade Bypass northern terminal roundabout (Kingsferry Interchange) to a point on the existing A249 trunk road about 250 metres northeast of the point where the road crosses the Sittingbourne to Sheerness Railway line; and

      (ii) a route being about 1.63 kilometres in length and marked "2" on the plan, from a point on the existing A249 trunk road about 100 metres southwest of its junction with Ferry Road to a point on the access road to Neatscourt Car Depot about 130 metres from its junction with the A249 trunk road,

    all in the Borough of Swale, in the County of Kent.



SCHEDULE 2
The location and general design of the new bridge crossing the Swale are shown on the plan.

Points of commencement and Termination of the Bridge

CommencementThe bridge commences approximately 486 metres southwest of the point where the existing Kingsferry Bridge crosses the southwest bank of the Swale.
TerminationThe bridge terminates approximately 571 metres northeast of the point where the existing Kingsferry Bridge crosses the northeast bank of the Swale.
SpansThe overall length of the bridge is 1270.5 metres in nineteen spans. The central span is 92.5 metres.
HeadwayNot less than 29 metres above Mean High Water Spring tide level, this being 2.8 metres Above Ordnance Datum (AOD) Newlyn.
WaterwayA minimum clear navigable waterway of 72.5 metres.
Overall DimensionsThe bridge will be 1270.5 metres long and will carry a dual carriageway 7.3 metres wide (two lanes) in each direction. The central reserve will be 2.5 metres wide (including 0.7 metre wide hard strips) and there will be a 0.7 metre wide raised paved verge on the nearside of each carriageway.
