Whereas in pursuance of article 18 of the Medical Act 1983 (Amendment) Order 2000[1] the General Medical Council have made the General Medical Council (Interim Orders Committee) (Transitional Provisions) Rules 2000 as set out in the Schedule to this Order: And whereas by paragraph 1(5) of Schedule 4 to the Medical Act 1983[2] such rules shall not have effect until approved by Order of the Privy Council: Now, therefore, Their Lordships, having taken the said rules into consideration, in exercise of the powers conferred by the said paragraph 1(5), do hereby order as follows: - 1.The said rules are hereby approved. 2.This Order may be cited as the General Medical Council (Interim Orders Committee) (Transitional Provisions) Rules Order of Council 2000, and shall come into force on 3rd August 2000. Galloway Clerk of the Privy Council The General Medical Council, in exercise of their powers under article 18 of the Medical Act 1983 (Amendment) Order 2000 [3], after consulting with such bodies of persons representing medical practitioners as appear to the Council to be requisite to be consulted, and of all other powers enabling the Council in that behalf, hereby make the following Rules: Citation and commencement 1.These Rules may be cited as General Medical Council (Interim Orders Committee) (Transitional Provisions) Rules 2000 and shall come into force on 3rd August 2000. Commencement 2.In these Rules -
Transitional provision
(b) the Committee has considered whether to make an order for interim suspension or an order for interim conditional registration under section 42 but has postponed its decision until a further date falling on or after the coming into force of the Order; or (c) the committee has made an order for interim suspension or an order for interim conditional registration under section 42 which is in force immediately prior to the date on which the Order comes into force, a decision as to whether an interim suspension order or an order for interim conditional registration should be made or a decision as to whether such an order made prior to the date on which the Order comes into force should be renewed or revoked, shall be made by the Interim Orders Committee.
(This note is not part of the Order) The rules approved by this Order give effect to powers provided for in the Medical Act 1983 (Amendment) Order 2000 (`the Order') to make rules in respect of cases where, on the date the Order comes into force, proceedings in respect of interim suspension or interim conditional registration have commenced before, but no order has been made by, the Preliminary Proceedings Committee or where such an order is in force following a decision by that committee. The rules provide that a decision as to whether an interim suspension order or an order for interim conditional registration should be made or, where such an order is already in force, a decision as to whether it should be renewed or revoked, shall be made by the Interim Orders Committee.
