The Immigration (Control of Entry through Republic of Ireland) (Amendment) Order 2000

The Secretary of State, in exercise of the powers conferred upon him by sections 9(2) and 32(1) of the Immigration Act 1971[1], hereby makes the following Order:

    1.This Order may be cited as the Immigration (Control of Entry through Republic of Ireland) (Amendment) Order 2000 and shall come into force on 30th July 2000.

    2.In article 4(2) of the Immigration (Control of Entry through Ireland) Order 1972[2], after "shall not apply to any person", there is inserted "who arrives in the United Kingdom with leave to enter or remain in the United Kingdom which is in force but which was given to him before his arrival or".

EXPLANATORY NOTE

(This note is not part of the Order)


Article 7 of the Immigration (Leave to Enter and Remain) Order 2000 provides that a person may be given leave to enter the United Kingdom before he arrives in the United Kingdom. Article 13 of that Order provides that a person's leave to enter or remain in the United Kingdom is not to lapse on his leaving the common travel area.

This Order amends article 4 of the Immigration (Control of Entry through Republic of Ireland) Order 1972 so that it does not apply to a person who arrives in the United Kingdom with leave to enter or remain in the United Kingdom which is in force and which was given to him before his arrival. Where article 4 applies, a person who enters the United Kingdom from the Republic of Ireland is subject to restrictions and conditions on his stay in the United Kingdom.
