The Secretary of State, in exercise of the powers conferred upon him by section 11 of the Channel Tunnel Act 1987[1] hereby makes the following Order: 1.This Order may be cited as the Channel Tunnel (International Arrangements) (Amendment No. 2) Order 2000 and shall come into force on 30th July 2000. 2. - (1) Schedule 4 to the Channel Tunnel (International Arrangements) Order 1993[2] is amended as follows. (2) After paragraph 1(11)(e), insert -
(eb) in paragraph 2A(6) -
(ii) after the words "joining a ship or aircraft" insert "or a shuttle train or through train"; and (iii) after the words "intended ship or aircraft", insert "or train";"[3]. (3) After paragraph 3, insert -
4.In the Immigration (Leave to Enter and Remain) Order 2000 -
(ii) after the words "before arrival", insert "or entry into the control zone"; and (iii) after the words "date of arrival", insert "or entry into the control zone"; (b) in article 4(3) -
(ii) after the words "before arrival", insert "or entry into the control zone"; and (c) in article 6(2)(a) after the words "arrives in the United Kingdom", insert "or enters a control zone in France or Belgium seeking to arrive in the United Kingdom through the tunnel system".".
(This note is not part of the Order) This Order amends the Channel Tunnel (International Arrangements) Order 1993 (S.I. 1993/1813). It modifies paragraph 2A of Schedule 2 to the Immigration Act 1971 (as inserted by paragraph 57 of Schedule 14 to the Immigration and Asylum Act 1999) so that immigration officers will be able to exercise the powers given to them by that paragraph in control zones in France and Belgium, as well as in the United Kingdom. This Order also modifies articles 4 and 6 of the Immigration (Leave to Enter and Remain) Order 2000 (S.I. 2000/1161) so that entry clearances will have effect as leave to enter the United Kingdom in control zones as well as on arrival in the United Kingdom.
