The Superannuation (Admission to Schedule 1 to the Superannuation Act 1972) (No. 2) Order 2000

The Minister for the Civil Service, in exercise of the powers conferred by section 1(5) and section 1(8)(b) of the Superannuation Act 1972[1] and now vested in him[2], hereby makes the following Order - 

Citation, Commencement and Interpretation
    1. - (1) This Order may be cited as the Superannuation (Admission to Schedule 1 to the Superannuation Act 1972) (No. 2) Order 2000 and shall come into force on 24th July 2000, but shall have effect, where appropriate, from the dates specified in this Order.

    (2) In this Order "the Act" means the Superannuation Act 1972.

Offices and Employments
    2. - (1) Section 1 of the Act shall apply to the following offices and employment with effect from the dates specified below - 

    (a) with effect from 1st May 1999 the office of the Director of Passenger Rail Franchising

    (b) the office of rent officer in respect of appointments taking effect on or after 1st October 1999

    (c) with effect from 1st December 1999 employment as a member of the staff of Resource: The Council for Museums, Archives and Libraries.

    (2) The above offices and employment are hereby added to those listed in Schedule 1 to the Act.

EXPLANATORY NOTE

(This note is not part of the Order)


Section 1 of the Superannuation Act 1972 (under which the Principal Civil Service Pension Scheme, the Civil Service Additional Voluntary Contribution Scheme and the Civil Service Compensation Scheme have been made) applies to employments and offices listed in Schedule 1 to that Act.

Article 2(a) of the Order adds the office of the Director of Passenger Rail Franchising to those listed in that schedule. The Office of the Director of Passenger Rail Franchising is created under section 1 of the Railways Act 1993. Under paragraph 3(a) of Schedule 1 to the Railways Act 1993 his remuneration is paid out of moneys provided by Parliament.

Article 2(b) of the Order adds to those listed in that Schedule the office of rent officer in respect of appointments made on or after 1st October 1999. The Administration of the Rent Officer Service (England) Order 1999 (S.I. 1999/2403) made under section 64B of the Rent Act 1977 (c. 42) came into force on 1st October 1999. It provides that the appointment, remuneration and administration of rent officers in England are to be functions of the Secretary of State for the Environment, Transport and the Regions rather than of local authorities.

Article 2(c) of the Order adds employment by Resource: The Council for Museums, Archives and Libraries ("Resource") to those listed in that Schedule. Resource is a company limited by guarantee, incorporated on 30th November 1999. Resource is funded by grant-in-aid from the Department for Culture, Media and Sport.
