Whereas a draft of this Order has been laid before, and approved by a resolution of, each House of Parliament pursuant to section 77(2) of the Deregulation and Contracting Out Act 1994[1]: Now, therefore, the Secretary of State in exercise of the powers conferred on him by sections 69 and 77(1)(b) of that Act hereby makes the following Order: - Citation and commencement 1. - (1) This Order may be cited as the Contracting Out (Functions in Relation to Petroleum Royalty Payments) Order 2000. (2) This Order shall come into force on the day after the day on which it is made. Contracting out of the functions of the Secretary of State 2.Any function of the Secretary of State (not being a function excluded from section 69 of the Deregulation and Contracting Out Act 1994 by section 71(1) of that Act) which relates to or is connected with the payment or repayment of any sum by way of royalty which is conferred on him by:
(b) section 6 of that Act, may, to such extent as may be specified in the authorisation, be exercised by, or by employees of, such person (if any) as may be authorised in that behalf by the Secretary of State. (This note is not part of the Order) This Order provides that certain functions, set out in article 2, relating to the payment or repayment of petroleum royalty conferred on the Secretary of State by or under the Petroleum Act 1998 may be exercised by any person (or his employees) whom the Secretary of State may authorise to do so (article 2). Apart from the function conferred by section 6 of the 1998 Act relating to repayment of royalty, the Secretary of State's functions relating to royalty are set out in particular conditions attached to certain petroleum licences granted (or treated as having been granted) under section 3 of the 1998 Act.
