The South Birmingham Mental Health National Health Service Trust (Transfers of Trust Property) Order 1999

The Secretary of State for Health, in exercise of the powers conferred on him by section 92(1) of the National Health Service Act 1977[1] and of all other powers enabling him in that behalf, having regard to the changes in the arrangements for the administration of hospitals and other establishments and facilities previously managed by the South Birmingham Mental Health National Health Service Trust[2], and having consulted that Trust and the bodies specified in column (1) of the Schedule to this Order in accordance with section 92(3) of that Act, hereby makes the following Order:

Citation, commencement and interpretation
    1. - (1) This Order may be cited as the South Birmingham Mental Health National Health Service Trust (Transfers of Trust Property) Order 1999 and shall come into force on 30th December 1999.

    (2) In this Order - 

    "the Schedule"means the Schedule to this Order;

    "the Trust" means the South Birmingham Mental Health National Health Service Trust;

    "the trust property" means, in the case of each body specified in column (1) of the Schedule, the items specified in a schedule of trust property prepared by, agreed upon by and signed on behalf of that body and the Trust on the date specified in relation to that body in column (2) of the Schedule.

Transfers of Trust Property
    2.On 30th December 1999, in the case of each body specified in column (1) of the Schedule, the trust property shall be transferred from the Trust to that body.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order transfers on 30th December 1999 to the bodies specified in column (1) of the Schedule to the Order trust property held by the South Birmingham Mental Health National Health Service Trust. A copy of the schedule of trust property transferred to each body can be obtained from the Department of Health, Financial and Audit Support Branch, Quarry House, Quarry Hill, Leeds LS2 7UE.
