The Secretary of State, in exercise of the powers conferred on him by section 39(5), (6) and (7) of the Local Government and Housing Act 1989[1] and of all other powers enabling him in that behalf, hereby makes the following Order: 1.This Order may be cited as the Public Airport Companies (Capital Finance) (Amendment) Order 1999 and shall come into force on 1st April 1999. 2.The Public Airport Companies (Capital Finance) Order 1996[2] shall be amended as follows: (1) In paragraph (2) of article 1 for the definition of "public airport company" there shall be substituted the following definition:
(2) In paragraph (3) of article 1 for the words "the Schedule" there shall be substituted the words "Schedule 2". (This note is not part of the Order) This Order amends the Public Airport Companies (Capital Finance) Order 1996. The principal amendments change the definition of public airport company so that it ceases to refer to all such companies as defined in section 16(1) of the Airports Act 1986 (1986 c. 31) but is confined to those companies listed in new Schedule 1 to the Order. Of those airports, Gloucestershire, Humberside and Teesside are also named in Schedule 2 for the purpose of identifying the constituent council which is to be treated as the controlling authority for the purposes of the principal Order.
