The Local Government Act 1988 (Defined Activities) (Housing Management) (Exemptions) (Wales) (Amendment) Order 1998

The Secretary of State for Wales, in exercise of the powers conferred upon him by section 2(9) of the Local Government Act 1988[1] and of all other powers enabling him in that behalf, hereby makes the following Order:-

Citation, commencement and interpretation
    1. - (1) This Order may be cited as the Local Government Act 1988 (Defined Activities) (Housing Management) (Exemptions) (Wales) (Amendment) Order 1998 and shall come into force on 30th September 1998.

    (2) In this Order, "the principal Order" means the Local Government Act 1988 (Defined Activities) (Housing Management) (Exemptions) (Wales) Order 1997[2].

Amendment of the principal Order
    2.In article 5 (the conditions) of the principal Order for paragraph (3) substitute the following-

Revocation
3.The Local Government Act 1988 (Defined Activities) (Housing Management) (Exemptions) (Wales) (Amendment) Order 1997[3] is revoked.

EXPLANATORY NOTE

(This note is not part of the Order)

The present Order amends the Local Government Act 1988 (Defined Activities) (Housing Management) (Exemptions) (Wales) Order 1997 (S.I. 1997/934) (as amended by S.I. 1997/1701 and S.I. 1997/2648) ("the principal Order"). This is in consequence of the Schedule to the Local Government Act 1988 (Competition) (Wales) Regulations 1998 (S.I. 1998/2192) which has substituted 1st October 2000 as the date for the application of compulsory competitive tendering requirements in respect of housing management services by county and county borough councils in Wales to which councils the exemption in the principal Order applies.

Article 2 amends article 5(3) of the principal Order, in respect of the tenant management organisation exemption, to provide that that exemption will now end by 1st October 2005.

Article 3 makes a consequential revocation of the Local Government Act 1988 (Defined Activities) (Housing Management) (Exemptions) (Wales) (Amendment) Order 1997 (S.I. 1997/1701).
