The Secretary of State, in exercise of the powers conferred by paragraphs 1(5) and 2(5) of Schedule 3 to the Road Traffic Act 1991[1], and of all other powers enabling him in that behalf, and after consultation with appropriate representatives of chief officers of police and appropriate associations of local authorities in accordance with paragraphs 1(6) and 2(6) of that Schedule, hereby makes the following Order: Citation, commencement and extent 1. - (1) This Order may be cited as the Road Traffic Act 1991 (Amendment of Schedule 3) (Scotland) Order 1998 and shall come into force on 4th October 1998. (2) This Order shall have effect as respects Scotland only. Amendment of the Road Traffic Act 1991 2.The amendments made to Schedule 3 to the Road Traffic Act 1991 by article 2 of the Road Traffic Act 1991 (Amendment of Schedule 3) (England and Wales) Order 1996[2] (except for the insertion, in paragraph 2(4) of that Schedule, of new paragraph (bb)) shall have effect in the application of that Schedule to Scotland. Calum MacDonald Parliamentary Under Secretary of State, Scottish Office St Andrew's House, Edinburgh 5th August 1998 (This note is not part of the Order) This Order, which extends to Scotland only, amends Schedule 3 to the Road Traffic Act 1991 by applying to Scotland that Schedule as already amended for England and Wales. Schedule 3 enables the designation of permitted and special parking areas outside London. The effect of the amendments is to include within Schedule 3 certain provisions of the Road Traffic Regulation Act 1984 (c.27) so that parking contraventions will give rise to a civil liability by the imposition of a penalty charge rather than being dealt with as criminal offences. In permitted parking areas contravention of an order under section 35 of the 1984 Act by a stationary vehicle will no longer be an offence; nor will it be an offence if a vehicle contravenes provisions of a traffic regulation order prohibiting or restricting the waiting, loading or unloading of vehicles on a road in the permitted parking area. In special parking areas it will no longer be an offence if a vehicle contravenes a temporary prohibition or restriction on waiting, loading or unloading.
