The Secretary of State for the Environment, Transport and the Regions, as respects England, in exercise of the powers conferred upon him by section 17(1) and (5) of the Housing Act 1996[1] and of all other powers enabling him in that behalf, hereby makes the following Order: Citation, commencement and interpretation 1. - (1) This Order may be cited as the Housing (Right To Acquire) (Discount) Order 1998 and shall come into force on 9th September 1998. (2) In this Order "area" means a "county" or "district" as defined by section 270 of the Local Government Act 1972[2], a London borough or the City of London. Amounts of Discount 2.The following amounts of discount are specified for the purpose of section 17(1)(a) of the Housing Act 1996 (the right to acquire) -
(b) Ј13,500 where a dwelling is in one of the areas specified in Schedule 2 to this Order; (c) Ј11,000 where a dwelling is in one of the areas specified in Schedule 3 to this Order; (d) Ј10,000 where a dwelling is in one of the areas specified in Schedule 4 to this Order; and (e) Ј9,000 where a dwelling is in one of the areas specified in Schedule 5 to this Order. (This note is not part of the Order) This Order specifies the amount of discount for the purposes of section 17 of the Housing Act 1996 (supplemental provisions on the right to acquire). Tenants of registered social landlords who have a right to acquire their homes under section 16 of the 1996 Act are able to do so with a discount from the purchase price. The amount of the discount varies according to the area in which the dwelling is situated. The Order replaces the Housing (Right to Acquire) (Discount) Order 1997. Under this Order, some areas are in different discount bands from before and the Order takes into account changes in local authority areas and names.
