The Wireless Telegraphy (Isle of Man) Order 1998

Present,

The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred on Her by subsection (3) of section 20 of the Wireless Telegraphy Act 1949[1] as that subsection has effect by virtue of section 9(2) of the Wireless Telegraphy Act 1998[2], and section 9(3) of the Wireless Telegraphy Act 1998, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows: - 

    1.This Order may be cited as the Wireless Telegraphy (Isle of Man) Order 1998 and shall come into force on 24th July 1998.

    2.Sections 1 to 8 and 10(1) of, and the Schedules to, the Wireless Telegraphy Act 1998 shall extend to the Isle of Man with the following adaptations and modifications - 

    (a) any reference to the Wireless Telegraphy Act 1949 shall be construed as a reference to that Act as extended to the Isle of Man by the Wireless Telegraphy (Isle of Man) Order 1952[3];

    (b) in section 2(3), for "4(3) of the Telecommunications Act 1984" substitute "2(3) of the Telecommunications Act 1984 (an Act of Tynwald)";

    (c) after section 3(5) insert - 

        " (5A) The Secretary of State shall pay to the Treasury of the Isle of Man for its general revenue such proportion of the sums received under subsection (5) as appears to the Secretary of State to be appropriate.";

    (d) in section 6(2)(a), for the words "the London, Edinburgh and Belfast Gazettes" substitute "a newspaper circulating in the Isle of Man";

    (e) in Schedule 1 - 

      (i) omit paragraph 3; and

      (ii) in paragraph 4, after "Broadcasting Act 1990" insert "as extended to the Isle of Man by the Broadcasting Act 1990 (Isle of Man) Order 1991"[4];

    (f) in Part I of Schedule 2 - 

      (i) after "section 3(2) to (5)" insert "as extended to the Isle of Man by the Wireless Telegraphy (Isle of Man) Order 1969"[5];

      (ii) after "section 74" insert "as extended to the Isle of Man by the Wireless Telegraphy (Isle of Man) Order 1995"[6]; and

      (iii) after "paragraph 2(2)" insert "as extended to the Isle of Man by the Broadcasting Act 1990 (Isle of Man) Order 1991"; and

    (g) omit Part II of Schedule 2.

This Order extends to the Isle of Man sections 1 to 8 and 10(1) of, and the Schedules to, the Wireless Telegraphy Act 1998, with the adaptations and modifications specified in the Order.
