The Fisheries and Aquaculture Structure (Grants) Amendment Regulations 1998

The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, acting jointly, in exercise of the powers conferred on them by the said section 2(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:

Citation and commencement
    1.These Regulations may be cited as the Fisheries and Aquaculture Structures (Grants) Amendment Regulations 1998 and shall come into force on 26th June 1998.

Amendment
    2.The Fisheries and Aquaculture Structures (Grants) Regulations 1995[3] ("the principal Regulations") shall be amended in accordance with regulation 3 below.

    3.In regulation 2(1) of the principal Regulations-

(a) for the definition of "the Council Regulation" there shall be substituted the following definition-

" "the Council Regulation" means Council Regulation (EC) No.3699/93 laying down the criteria and arrangements regarding Community structural financial assistance in the fisheries and aquaculture sector and the processing and marketing of its products[4] as amended by Council Regulation (EC) No.1624/95[5], Council Regulation (EC) No.2719/95[6], Council Regulation (EC) No.965/96[7] and Council Regulation (EC) No.25/97[8]"; and

(b) there shall be added at the end of paragraph (a)(v) in the definition of "relevant operation", the following-

" and promotion of operations by the fishery or aquaculture trade (article 13 of the Council Regulation)".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Fisheries and Aquaculture Structures (Grants) Regulations 1995 by-

(a) substituting the definition of the Council Regulation (Council Regulation (EC) No.3699/93) to take account of amendments to that Regulation, and

(b) adding to the definition of "relevant operation" in respect of which application for, and payment of, grant may be made, the promotion of operations by the fishery or aquaculture trade in accordance with article 13 of the Council Regulation.
