The Secretary of State for Health, in exercise of the powers conferred on him by section 126(3) of the National Health Service Act 1977[1] and section 5(1) of the National Health Service and Community Care Act 1990[2] and of all other powers enabling him in that behalf, having completed the consultation prescribed under section 5(2) of that latter Act[3] and considering it appropriate that the functions of the trust should include functions in relation to the provision of services for one or more Health Authorities[4], hereby makes the following Order: - Citation and commencement 1.This Order may be cited as the Oxfordshire Mental Healthcare National Health Service Trust (Establishment) Amendment Order 1998 and shall come into force on 1st June 1998. Amendment of Establishment Order 2.In the Oxfordshire Mental Healthcare National Health Service Trust (Establishment) Order 1993[5] -
3.The trust's functions (which include functions which the Secretary of State considers appropriate in relation to the provision of services by the trust for one or more Health Authorities) shall be: -
(b) to provide and manage pursuant to section 5(1)(b) of the Act the premises specified in Part II of the Schedule to this Order, and there to provide and manage hospital accommodation and services; (c) to own and manage pursuant to section 5(1)(a) of the Act the premises specified in Part III of the Schedule to this Order, and there to provide and manage community health services; and (d) to provide and manage pursuant to section 5(1)(b) of the Act the premises specified in Part IV of the Schedule to this Order, and there to provide and manage community health services."; and (b) at the end there shall be added the Schedule set out in the Schedule to this Order.

The Establishment Order is amended to confer on the trust the purpose specified in section 5(1)(b) of the National Health Service and Community Care Act 1990 in respect of those premises specified in Parts II and IV of the Schedule to the amended Establishment Order and, in pursuance of that purpose, extends the functions of the trust to include the function of providing and managing those premises.
