The Lord Chancellor, in exercise of the powers conferred on him by section 22(7) and (11) of the Courts and Legal Services Act 1990[1], hereby makes the following Order - Citation, commencement and interpretation 1. - (1) This Order may be cited as the Legal Services Ombudsman (Jurisdiction) (Amendment) Order 1998 and shall come into force on 23rd April 1998. (2) In this Order, "the 1990 Order" means the Legal Services Ombudsman (Jurisdiction) Order 1990[2]. Amendments to the 1990 Order 2.In article 3 of the 1990 Order -
(b) for the word "tribunal", there shall be substituted the word "tribunals"; and (c) for the word "is", there shall be substituted the word "are". 3.In the Schedule to the 1990 Order -
(b) the heading to Part II shall be amended by inserting the words "determinable by tribunals", after the word "Issues"; and (c) Part II shall be amended further by adding the words "The Disciplinary Tribunal of the Institute of Legal Executives", after the words "The Discipline and Appeals Committee of the Council for Licensed Conveyancers".
(This note is not part of the Order) The Legal Services Ombudsman has jurisdiction to investigate allegations about the manner in which a complaint made to a professional body has been dealt with by that body. Part I of the Schedule to the Legal Services Ombudsman (Jurisdiction) Order 1990 lists the professional bodies over which the Legal Services Ombudsman has jurisdiction and Part II of the Schedule lists the tribunals over which the Ombudsman does not have jurisdiction. This Order amends Part I of the Schedule to add the Institute of Legal Executives and amends Part II of the Schedule to add their Disciplinary Tribunal. These amendments are necessary as a result of the Institute of Legal Executives Order (S.I. 1998/1077), which authorises that body to grant rights of audience before a court to its members under section 27 of the Courts and Legal Services Act 1990.
